New York’s Pay Transparency Law takes effect on September 17, 2023, and applies to all employers in New York State with four or more employees regardless of where they are located.
Job postings for positions including those to be filled internally (promotions and transfers) that will either be performed in New York or report to a position or office in New York must include the compensation or intended compensation range. In addition, if a job description exists for advertised positions, it must also be disclosed and made public. Commission-only positions need only state that compensation will be based entirely on commission.
For this law, the term employee is much broader than other labor laws. It includes owners, independent contractors, part-time employees, paid interns, and domestic workers.
